1. AGREEMENT

By purchasing, accessing or participating in Battle Ready Online Training, you agree to be bound by these Terms and Conditions.

If you do not agree, you must not enrol or participate.

This agreement is governed by the laws of Australia.

2. ELIGIBILITY

Participation is available to individuals aged 16 years and older.

Participants aged 16–17 years must:

  • Confirm they have informed consent from a parent or legal guardian prior to enrolling.

  • Confirm that a parent or legal guardian has reviewed and approved these Terms and Conditions.

By enrolling as a participant under 18 years of age, you represent and warrant that parental consent has been obtained.

Outperform Fitness Pty Ltd reserves the right to request written parental confirmation at any time.

3. MINOR PARTICIPANTS (UNDER 18)

Where a participant is under 18 years of age:

  1. The participant confirms they have parental or guardian permission to participate.

  2. The parent or guardian acknowledges that physical training involves inherent risks.

  3. The parent or guardian agrees to be jointly responsible for the minor’s participation and compliance with these Terms.

  4. The parent or guardian accepts financial responsibility for membership fees.

  5. The parent or guardian agrees that the training services are beneficial and appropriate for the minor.

The services provided are fitness coaching services intended to improve health, strength and performance and are considered beneficial services for minors under Australian law.

4. NATURE OF SERVICES

Battle Ready Online Training is a fully online fitness coaching program.

No in-person training sessions are included unless expressly stated in writing.

The program may include:

  • Structured training plans

  • Online coaching support

  • Performance guidance

  • General nutrition guidance

Members are responsible for securing access to appropriate gym facilities and equipment required to complete the program.

Outperform Fitness Pty Ltd does not provide physical gym access.

Failure to access appropriate facilities does not entitle a member to refunds or suspension outside the stated policy.

5. HEALTH SCREENING AND MEDICAL RESPONSIBILITY

All members complete a health screening questionnaire during onboarding.

By participating, you confirm that:

  • You are medically fit to engage in physical training; or

  • You have obtained medical clearance from a qualified professional.

You are responsible for disclosing any relevant health conditions.

You agree to cease training and seek medical advice if symptoms such as dizziness, chest pain, or unusual discomfort occur.

6. ASSUMPTION OF RISK

You acknowledge that physical training carries inherent risks, including but not limited to:

  • Muscle strain

  • Joint injury

  • Cardiovascular stress

  • Illness or injury

You voluntarily assume all risks associated with participation.

To the extent permitted by law, you release Outperform Fitness Pty Ltd, its directors, employees, contractors and coaches from liability for injury, loss or damage arising from participation, except where liability cannot be excluded under Australian Consumer Law.

7. NUTRITION GUIDANCE

The program may include general nutrition guidance.

While a qualified nutrition professional may contribute to program development, not all coaches are qualified nutritionists.

Nutrition information provided is general in nature and does not constitute medical, dietetic or therapeutic advice.

You are responsible for seeking professional advice before making dietary changes.

8. MEMBERSHIP STRUCTURE

8.1 7-Day Trial

Members may commence with a 7-day trial for $1.

  • $1 is charged at sign-up.

  • The trial begins on the next available Monday start date.

  • Full access is provided during the trial.

If not cancelled before billing, the membership automatically commences under the selected minimum term.

8.2 Minimum Terms

Members select one of the following commitment periods:

  • 1 Month

  • 3 Months

  • 6 Months

Billing occurs weekly.

After completion of the selected minimum term, membership continues week-to-week until cancelled in accordance with these Terms.

9. PAYMENTS

Membership fees are billed weekly via Stripe or nominated payment provider.

By enrolling, you authorise recurring weekly billing.

Failure to make payment may result in suspension or termination of access.

10. CANCELLATION

10.1 During Trial

Members may cancel during the 7-day trial by:

  • Messaging their coach or support team; and

  • Completing the required cancellation form

Cancellation must occur before the first weekly billing.

10.2 After Minimum Term

After completing the selected minimum term:

  • Membership continues week-to-week.

  • 14 days’ written notice is required to cancel.

  • Weekly billing continues during the notice period.

10.3 Early Cancellation During Minimum Term

Early cancellation is permitted only under special circumstances:

Enlistment
Proof required: Official letter of offer

Medical
Proof required: Documentation from a qualified medical professional

If approved, cancellation will occur without further minimum term obligations.

If early cancellation is requested outside approved circumstances:

  • 14 days’ written notice applies (billed at full weekly rate); and

  • 50% of the remaining minimum term is payable, where permitted under applicable law.

11. SUSPENSIONS

Members may suspend their membership:

  • Up to 8 weeks per calendar year

  • Minimum suspension: 2 weeks

  • Maximum suspension during minimum term: 4 weeks

  • 3 days’ written notice required

  • Suspensions commence on Mondays

During suspension:

  • Billing is paused

  • The minimum term pauses and extends by the suspension duration

Suspension requests must be submitted in writing.

12. INTELLECTUAL PROPERTY

All program materials, training plans, content and resources remain the property of Outperform Fitness Pty Ltd.

Members must not:

  • Copy or distribute materials

  • Share login details

  • Reproduce or resell program content

Unauthorised distribution may result in termination and legal action.

13. MEMBER CONDUCT

Members agree to act respectfully within:

  • Online communications

  • Coaching interactions

  • Community groups

Abusive, threatening or inappropriate conduct may result in termination of access without refund.

14. MEDIA RELEASE

By participating, you grant Outperform Fitness Pty Ltd permission to use:

  • Images

  • Videos

  • Testimonials

  • Progress updates

For marketing and promotional purposes.

If you do not wish for your image or content to be used, you must notify us in writing.

15. LIMITATION OF LIABILITY

To the extent permitted by law, Outperform Fitness Pty Ltd is not liable for:

  • Indirect or consequential loss

  • Loss of income

  • Loss of opportunity

Nothing in these Terms excludes rights under Australian Consumer Law.

16. CHANGES TO TERMS

Outperform Fitness Pty Ltd may update these Terms and Conditions at any time.

Continued participation constitutes acceptance of updated Terms.

17. GOVERNING LAW

These Terms are governed by the laws of Australia.
